TERMS OF USE - BCSRECRUIT.COM (CANDIDATES)

BCSRECRUIT.COM WEBSITE – THE JOBSITE FOR IT PROFESSIONALS

This website, BCSrecruit.com (the “Site”) is the website of the British Computer Society (“BCS”).

Unless specifically stated otherwise, BCS is not responsible for the information relating to BCS or any information and services provided by BCS through or via the Site including job advertisements placed by registered job advertiser (whether a recruitment agency or independent employer) (“Employer User”) and your application process to apply for jobs online on the Site (the “Services”) and makes no warranty in respect of the timeliness, accuracy or availability.

The information provided is subject to BCS Privacy Policy which you should read before accessing such information.

LEGAL AGREEMENT

By entering the Site, and/or any page accessible on this Site you accept, without limitation or qualification, the terms and conditions set out below (the “Terms”) without modification. By accessing and using this Site, you acknowledge that you are bound by these Terms.

If you do not wish to be bound by these Terms you should not access or use the Site.

BCS may modify the Terms in its absolute discretion from time to time without individual notice to you. You will be deemed to have accepted any modifications if you continue to use the Site after they have been posted.

YOU SHOULD PRINT AND RETAIN A COPY OF THESE TERMS.

REGISTRATION OF USERS AND PRIVACY OF YOUR DATA

You are required to complete the BCS registration process on this Site (http://www.bcsrecruit.com/register/register_1.asp). You are not obliged to provide BCS with any optional information requested.

In completing the registration process and submitting your personal information to BCS, you hereby consent to the BCS submitting your information to Employer Users when you apply for advertised roles.

Owing to the global nature of the infrastructure, the information you provide may be transferred in countries outside the European Economic Area. The Employer Users may operate globally and so it may be necessary to transfer and process your personal information to other companies outside of the EEA. The countries outside of the EEA may not have similar protections in place regarding your data and its use as set out in BCS’s Privacy Policy (see link above).

BCS may monitor your use of the Site including any job applications you make to generally improve the Site and the Services and to retain records to be used in the event of complaints or customer service issues.

In the event that BCS undergoes a reorganisation or its business is sold to a third party, you agree that any personal information BCS holds about you may be transferred to that reorganised entity or third party.

BCS stores and processes data strictly in accordance with the Data Protection Act 1998. BCS’s use of your personal information is processed in accordance with BCS Privacy Policy (see link above).

WHAT YOU ARE ALLOWED TO DO

You may browse the Site using a compatible web browser.

You may view the Site on your computer screen and print a copy of the information posted on the Site provided it is for your own personal and non-commercial purposes only and in accordance with these Terms.

WHAT YOU ARE NOT ALLOWED TO DO

Except to the extent expressly set out in these Terms, you are not allowed to make any copies of any part of the Site.

Other than your registered details, you may not remove or change anything on the Site, including but not limited to any copyright, trade mark or other intellectual property right notices contained in the original material or from any material copied or printed off from the Site.

You may not arrange for any websites operated by parties other than BCS (“Third Party Websites”) to be connected to any part of the Site by hyperlink or otherwise without BCS’s consent which will only be given on the basis that any such link will be to the BCS homepage.

You must only use the Site and anything available from the Site for lawful purposes, and you must comply with all applicable laws, statutes and regulations. You must not use the Site or Services to:

(a) spider or otherwise access the Site by any automated means with a view to re-using any of the content for commercial purpose;

(b) send, post, publish, disseminate, upload or otherwise transmit information or pictures that are obscene or pornographic, infringing, threatening, menacing, racist, offensive, defamatory, indecent or otherwise unlawful;

(c) make available or upload files that contain software or other materials, data or information in breach of any intellectual property rights or in breach of confidence or collection information about others (e.g. names / addresses) without their prior consent;

(d) impersonate anyone else or otherwise misrepresent your identity or status, or create a false identity or origin or email address or try to mislead BCS or other as to identity or origin of any communications or to provide inaccurate or unreliable contact details;

(e) modify, access or make available data stored on a computer or device which you have accessed through our network, when either: the owner of the data, computer or device has taken steps to prevent you from doing this; or the owner has expressed a wish that you do not do this;

(f) hack, obtain or attempt to obtain unauthorised access, through whatever means to the Site or any other related computer system;

(g) make excessive traffic demands or forward chain letters, surveys, contests, pyramid schemes or use the Site in any way to send unsolicited (commercial or otherwise) e-mail or any material for marketing or publicity purposes or otherwise engage in any other unlawful or objectionable behaviour that may reasonably be expected to inhibit other users from using and enjoying the Site or any other web site or impair the functionality of the Site or damage or destroy the reputation of BCS or any third party;

(h) make available, upload or distribute by any means any material or files that contain any viruses, bugs, corrupt data, “trojan horses”, “worms”, or other harmful software;

(i) apply for positions for which you do not have the appropriate legal documentation including citizenship and/or work permits;

(j) submit CVs or details of experience which are not accurate and up-to-date.

You agree to indemnify BCS, its officers, employees and licensors in respect of any loss that it or they may suffer as a result, directly or indirectly, or any breach by you of this undertaking.

BCS accepts no obligation to monitor the use of the Site. However, BCS reserves the right to disclose any information as required by law and/or to remove, refuse to post or to edit any information or materials, to block your access and to take such other action as may be reasonably necessary to prevent any breach of these Terms or any breach of applicable law or regulation.

BCS will also in its absolute discretion fully co-operate with law enforcement and other relevant authorities with respect to any investigation of suspected unlawful activity or violation of network security.

PASSWORD AND DETAILS

For registration and use of the Site, your username will be the email address you supply. During registration you will create a confidential password to be used when using the Services. You must keep your password confidential at all times, and must not disclose it to anyone else or permit anyone else to use it. Any breach of any of these Terms by anyone to whom you disclose the password will be treated as if the breach had been committed by you, and will not relieve you of your obligations under these Terms.

In the event of any failure or error in the operation of a password you shall cease using the password and exit the Site immediately, and notify BCS of such failure or error. BCS reserves the right to change, or to require you to change, your password at any time in its sole discretion.

You warrant that you are entitled to receive emails at the email address you provide. You should note that many companies prohibit their employees using the company email for private use and we encourage you to open a private account and use an outside computer network to visit the Site.

YOUR OBLIGATIONS

In consideration of your use of the Service you agree to the following:

(a) All information posted is your responsibility and you agree to provide true, accurate, current and complete information about yourself as prompted by the registration process;

(b) You will maintain all the registration data up to date in order to keep it true, accurate, current and complete;

(d) You will allow BCS to use the information you have provided for the purpose of operating the Service for you.

BCS may request confirmation of your identity in order to prevent abuse of the Site. If requested, failure to provide such information within 14 days without reasonable cause shall lead to immediate termination of the agreement and further, to refuse any and all future use of the Service.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in any material (including data, text, photographs and other images and sound, trade marks and logos) contained in this Site are either owned by BCS or have been licensed to BCS by the rights owner(s).

You are only allowed to use this Site and the material contained in the Site as set out in these Terms. Without BCS’s written consent, you may not use, transfer, copy or reproduce any part of the content of the Site, this Site or its source HTML in whole or in part, in any form or by any means electronic, mechanical or otherwise, except for the sole purpose of viewing its content. This includes electronic reproduction by uploading or downloading.

All database rights (pursuant to the Copyright and Rights in Databases Regulations 1997) and all other applicable intellectual property rights in the candidate database and in the jobs' database belong to BCS. You acknowledge that you do not acquire any rights in either database except as set out in these Terms.

You warrant that it is legal for you to view this site in the jurisdiction to which you are subject. You are responsible for compliance with all law of that jurisdiction, in viewing or using the content of the Site.

VIRUS PROTECTION AND COMPATIBILITY

While certain precautions have been taken to detect computer viruses and ensure security, BCS can not guarantee that the Site is virus-free and secure.

BCS shall not be liable for any loss or damage which occurs as a result of any virus or breach of security. BCS does not give any warranties as to the compatibility of the Website with your computer systems, software and/or hardware.

LINKS TO THIRD PARTY SITES

This site contains links to Third Party Websites. These links are provided for your convenience. When you activate one of them, you will leave the Site. BCS has no control over and will not accept responsibility or liability in respect of Third Party Websites and does not endorse any content, advertising, products or other materials in relation to the Third Party Websites or any association with their operator. You should read the Terms and privacy policy of the Third Party Websites carefully before using them.

DISCLAIMER AND LIMITATION OF LIABILITY

Notwithstanding anything in these Terms, BCS does not exclude or limit BCS' liability for death or personal injury resulting from its negligence, fraud or any other liability which may not by applicable law be excluded or limited. Your statutory rights as a consumer are not affected by any of these terms.

BCS shall not be liable (whether for breach of contract, negligence or for any other reason) for any failure by you to contact an advertiser of a position for employment or to secure a position for employment, loss of salary, loss of profits, exemplary or special damages, loss of sales, loss of revenue, loss of goodwill, loss of any software or data, loss of bargain, loss of opportunity, loss of use of computer equipment, software or data, loss of or waste of management or other staff time, or for any indirect, consequential or special loss, arising out of the use or performance of this Site, the provision of or failure to provide the Services, or for any information obtained through this Site, or otherwise arising out of the use of this Site, whether based on contract, tort, or otherwise, without limitation, even if BCS has been advised of the possibility of damage.

If you are dissatisfied with any portion of this Site, or with any of these Terms of use, your sole remedy, except as specifically provided in these Terms, is to stop using the Site.

Advertisements for positions are placed by the Employers and are not the responsibility of nor endorsed by BCS. You agree that the obtaining or viewing of any advertisements for positions or any other material through the use of the Service is carried out at your own risk and that BCS has no liability to you in respect of such things. In particular, we do not warrant or guarantee at any time that you will receive any alerts from Employers regarding potential positions.

You agree that your use of the Service is on an "as is" and "as available" basis and that your use of the Service is at your sole risk. BCS expressly disclaims all conditions, warranties or other terms in relation to the Site or the Service and in particular none as to any contents or accuracy of any advertisement for any position of employment (including any implied term as to quality, fitness for a particular purpose or compliance with any codes or laws relating to advertising, employment or discrimination), warranties of technical efficiency, satisfactory quality, availability, non-infringement, completeness and fitness for a particular purpose.

BCS may change the format and content of the Site and/or the Services from time to time without warning. You should refresh your browser each time you visit the Site to ensure that you download the most up to date version of the Site. Without prejudice to any other accrued rights, BCS may make available such information or material when required to do so by law or when requested to do so by regulatory bodies or law enforcement organisations.

TERMINATION

You acknowledge that there may be periods where access to or use of the Site or pages linked to it may be limited or impossible due to changes effected to the Site by way of ongoing development and improvement.

BCS may restrict your access to the Website, refuse to correspond with you, remove your details from the relevant database and/or terminate the Services without prejudice to any accrued rights, without prior notice to you where:

there is a regulatory or statutory change limiting the ability to provide access to the Site;

there is any event beyond the reasonable control of BCS preventing BCS from providing access to the Site (for example and without limitation, technical difficulties, capacity problems and communications failure);

BCS considers in its sole discretion that you are abusing the Site or are otherwise acting in breach of these Terms.

GENERAL

Unless otherwise specified, the Site is directed solely at those who access this site from the United Kingdom. Those who choose to access the Site from locations outside of the UK are responsible for compliance with local laws if and to the extent local laws are applicable.

These Terms form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter (save that these Terms shall not prejudice the agreement between BCS and Employers in relation to roles advertised). If any provision of these Terms is found to be unenforceable, this shall not affect the validity of any other provision.

BCS may delay enforcing its rights under these Terms without losing them.

None of these Terms shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by any third party.

You agree that BCS may sub-contract the performance of any of its obligations or may assign these Terms or any of its rights or obligations without giving you notice.

Any and all notices to be given by either one of us to the other pursuant to or in connection with these Terms shall be deemed sufficiently given when forwarded by e-mail or facsimile transmission in each case addressed to you at the e-mail address or facsimile number you have given us or to us at the e-mail address or facsimile number displayed on the Site.

These Terms shall be governed and interpreted in accordance with English law and you consent to the exclusive jurisdiction of the English courts.
